1. Eligibility and use of the website

You must be at least the age of majority in your place of residence and legally able to enter into a binding contract. You agree to provide current, complete, and accurate information and to use the website only for lawful personal or business purposes.

We may refuse service, restrict access, or cancel activity that appears unlawful, abusive, fraudulent, or inconsistent with these Terms.

2. Products and descriptions

We aim to describe and photograph products accurately. Color, scale, and finish may vary slightly because of lighting, screen settings, natural material variation, and manufacturing tolerances. Product measurements are approximate unless expressly stated otherwise.

Availability is not guaranteed. We may correct typographical errors, update product information, or withdraw an item before an order is accepted.

3. Prices, taxes, and payment

Prices are displayed in United States dollars unless another currency is clearly shown. Applicable shipping charges, sales tax, duties, or other governmental charges may be added or collected separately based on the delivery destination.

Payment must be authorized through an available payment method or secure payment request. You represent that you are authorized to use the selected payment method. We do not store complete payment-card numbers; payment information is handled by the relevant payment provider.

4. Orders and contract formation

Adding an item to a bag or submitting order details does not guarantee acceptance. Your order is an offer to purchase. A binding sales contract is formed only when mimox confirms acceptance and successfully receives or authorizes payment.

We may decline or cancel an order before acceptance because of inventory, pricing or description errors, suspected fraud, payment issues, delivery restrictions, or other reasonable operational concerns. If payment has already been collected for a cancelled order, the applicable amount will be refunded to the original payment method.

5. Shipping and delivery

Orders are prepared and delivered according to our Shipping Policy, which forms part of these Terms. Delivery dates are estimates rather than guarantees. Risk of loss passes as permitted by applicable law when the order is delivered to the stated address.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address, refused delivery, or unclaimed shipment may be charged where permitted by law.

6. Returns, refunds, and exchanges

Eligible returns are governed by our Return & Refund Policy. A return must be authorized before it is sent. Hygiene-sensitive earrings must be unused, unworn, and in their original condition and packaging unless applicable law provides otherwise.

Nothing in these Terms limits non-waivable consumer rights or remedies available under applicable law.

7. Warranty and after-sales service

Our Service & Warranty Policy describes inspection, defect reporting, exclusions, and available remedies. Normal wear, accidental damage, misuse, improper cleaning, loss, theft, and unauthorized repair are not manufacturing defects.

8. Intellectual property

The website, mimox name, product copy, layout, graphics, photographs, and other content are owned by or licensed to mimox and are protected by applicable intellectual-property laws. You may not reproduce, distribute, sell, scrape, or commercially exploit that content without prior written permission.

9. Limitation of liability

To the fullest extent permitted by law, mimox is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the website or products. Where liability cannot be excluded, our aggregate liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so these provisions apply only to the extent permitted in your jurisdiction.

10. Governing law and disputes

These Terms and Conditions are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the state or federal courts located in California, United States, except where mandatory consumer law requires another forum or procedure.

Before filing a claim, the parties agree to make a good-faith effort to resolve the matter by contacting client care and allowing a reasonable opportunity for response.

We may update these Terms when our services, practices, or legal obligations change. The version posted when an order is accepted will govern that order unless applicable law requires otherwise.
